Terms of usefor the application service for the recognition of foreign professional qualifications (referred to as the application service for recognition)

The application service for recognition is a service provided by the Ministry of Employment, Health and Welfare of the State of North Rhine-Westphalia (MAGS NRW). The application service for recognition enables users to have their foreign professional qualifications recognized by way of an electronic application.

1. Scope of the terms of use

These terms of use govern the relationship between the user of the application service for recognition and MAGS NRW. All users must acknowledge the terms of use and accept them when using the application service for recognition. MAGS NRW reserves the right to amend the terms of use as necessary.

2. Requirements for the use of the application service for recognition

2.1 Authentication procedure

The application service for recognition requires users to authenticate themselves using the Federal User Account BundID. Additional hardware and software may be required to register and use the Federal User Account BundID. For example the App “AusweisApp” can be used to read personal data from an ID card in the Federal User Account BundID. To do so, you need either a card reader or a suitable smartphone. 2.2 Other technical requirements

To use the application service for recognition, you need the following:

  • an Internet connection
  • the latest version of a browser (e.g. Chrome, Firefox or Safari)
  • Javascript activated in the browser
  • cookies activated
  • an email address

The portable document format (PDF) is the permitted file type for uploading files to the application service for recognition. The application and any attachments may not exceed a total file size of 30 MB.

2.3. Saving information entered during the application procedure

Users have the option to pause the application procedure and save the information they have entered so far in the application service for recognition. This function is only available if users authenticate themselves by way of an user account of BundID before the application procedure begins. It gives users time to obtain the information and documents that they do not yet have but are required when submitting applications.

3. Availability of the application service for recognition

MAGS NRW provides access to the application service for recognition within the scope of its technical and organizational capabilities. As a rule, the application service for recognition is available to users at all times. The service may be restricted or unavailable due to maintenance, faults or force majeure. Users do not have a right to constant, uninterrupted availability of the service. However, the operation of the application service for recognition is organised in such a way that technical problems are resolved quickly.

The delivery of a submitted application to the responsible authority may be delayed due to maintenance, faults or force majeure. Users who have submitted applications do not have a right to a specific delivery date.

4. Sending and receiving electronic documents

An application via the application service for recognition is only deemed to be submitted when the corresponding dataset has been received by the responsible authority. Once the application has been sent, users can download confirmation of this.

5. User obligations

5.1 Complete and correct information

Users are not permitted to gain unauthorized access to registrations, computer systems or networks that are linked to the server in the aforementioned data centres by decrypting codes, illegally procuring passwords or other methods.

5.2 Password confidentiality

Users are not permitted to gain unauthorized access to registrations, computer systems or networks that are linked to the server in the aforementioned data centres by decrypting codes, illegally procuring passwords or other methods.

MAGS NRW is not liable for damage incurred by users as a result of third parties utilizing passwords or registrations for the user account of BundID on the , either with or without the users’ knowledge. Users can be made liable for damage and expenses incurred by the competent authority or another party due to the use by a third party of users’ registrations or passwords to the extent that users are at fault.

5.3 Use of the application service for recognition

the application service for recognition and the information or content contained in it may only be used to submit an application. Users are not granted any further rights. Any reproduction or use of the content or parts thereof in other electronic or printed publications or any publication thereof is permitted only with prior consent. Section 53 of the German Copyright Act (UrhG) remains unaffected.

The application service for recognition may not be used in a manner that could damage, deactivate, overload or otherwise detrimentally affect a server or the network of the operators of the application service for recognition or third-party networks or servers, or could detrimentally affect the use by third parties of the application service for recognition. Uploading electronic data of any nature that is not related to the application procedure is prohibited.

5.4 Right to block users in the event of a violation of user obligations
